Agreement to Terms

By accessing or using The Sofos ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

Description of Service

The Sofos is a brain gaming platform that offers 10+ educational games along with curated learning content in philosophy, physics, mathematics, literature, and other subjects. Our Service includes brain training games, daily challenges, progress tracking, gamification features (badges, streaks, leaderboards), bite-sized lessons, and other learning tools.

User Accounts

Registration

To access certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

Account Security

You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion.

Free Trial and Subscriptions

Free Access

New users may access up to lessons free of charge without providing payment information. After completing lessons, you must subscribe to continue accessing content.

Subscription Plans

We offer monthly (€3/month) and yearly (€20/year) subscription plans. All prices are in Euros and exclude applicable taxes.

Payment

Payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method for the subscription fee and any applicable taxes.

Billing

Subscriptions automatically renew unless canceled before the renewal date. You will be charged at the beginning of each billing period.

Cancellation

You may cancel your subscription at any time from your account settings or billing portal. You will continue to have access until the end of your current billing period. No refunds will be provided for partial billing periods.

Refund Policy

We offer a 30-day money-back guarantee for yearly subscriptions. Monthly subscriptions are non-refundable except as required by law.

User Content and Conduct

Prohibited Uses

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Share your account credentials with others
• Attempt to circumvent any content protection or access control measures
• Copy, modify, distribute, or create derivative works of our content
• Use automated means (bots, scrapers) to access the Service
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to any part of the Service

Intellectual Property

Our Content

All content on The Sofos, including but not limited to text, graphics, logos, images, videos, audio, software, and course materials, is the property of The Sofos or its content suppliers and is protected by copyright, trademark, and other intellectual property laws.

License to Use

We grant you a limited, non-exclusive, non-transferable license to access and use the Service for your personal, non-commercial use. This license does not include the right to:

• Download or copy content (except for temporary caching)
• Modify or create derivative works
• Sell, resell, or commercially exploit any content
• Use content for any purpose other than personal learning

Gamification Features

Our gamification features, including badges, points, streaks, and leaderboards, are for motivational purposes only and hold no monetary value. We reserve the right to modify, suspend, or discontinue any gamification features at any time without notice.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• The content will be accurate, complete, or current
• Defects will be corrected
• The Service will meet your specific requirements

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SOFOS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability to you for all claims arising out of or relating to the Service shall not exceed the amount you paid us in the 12 months before the claim arose.

Indemnification

You agree to indemnify, defend, and hold harmless The Sofos and its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising out of your use of the Service, violation of these Terms, or violation of any rights of another.
